1. SCOPE
The following terms and conditions apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a legally capable partnership who acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.
2. CONTRACTING PARTIES, CONCLUSION OF CONTRACT, CORRECTION OPTIONS
The purchase contract is concluded with Markus Eker Fosure Candles.
By listing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially add our products to the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by e-mail once again.

We save the contract text and send you the order data and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the Internet.
4. DELIVERY CONDITIONS
Shipping costs are added to the stated product prices. For more information on the amount of shipping costs, please refer to the offers.
We only deliver by shipping. Unfortunately, self-collection of the goods is not possible.
5. Payment
The following payment methods are generally available in our shop:
Credit Card
By placing the order, you provide your credit card details. After your verification as the legitimate cardholder, the payment transaction will be processed automatically and your card will be charged.
PayPal, PayPal Express
During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, authenticate yourself with your login details, and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction is then automatically carried out immediately by PayPal. Sofort by Klarna
After placing the order, you will be redirected to the website of the online provider Sofort GmbH. To pay the invoice amount via Sofort, you must have a bank account enabled for online banking, authenticate yourself accordingly, and confirm the payment instruction to us. Further information is provided during the ordering process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.
Apple Pay
To pay the invoice amount via Apple Pay, you must use the "Safari" browser, where the service provider Apple is registered, have activated the Apple Pay function, authenticate yourself with your login credentials, and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. Further information is provided during the ordering process.
Google Pay
To pay the invoice amount via Google Pay, you must be registered with the service provider Google, have activated the Google Pay function, authenticate yourself with your login credentials, and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. Further information is provided during the ordering process.
Purchase on account via Klarna
In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer you the option to pay by invoice. Please note that Klarna invoice is only available for consumers and that payment must be made directly to Klarna. 6. RETENTION OF TITLE
The goods remain our property until full payment has been made.
7. WARRANTY AND GUARANTEES
Unless expressly agreed otherwise below, the statutory warranty law applies.
For used goods, the following applies: if the defect occurs after one year from the delivery of the goods, claims for defects are excluded. Defects that occur within one year from the delivery of the goods can be asserted within the statutory limitation period of two years from the delivery of the goods.
The above limitations and shortened deadlines do not apply to claims arising from damages caused by us, our legal representatives, or vicarious agents.
• in case of injury to life, body, or health
• in cases of intentional or grossly negligent breach of duty as well as fraud
• in the event of a breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on which the contracting party may regularly rely (cardinal obligations)
• within the scope of a warranty promise, as agreed or
• insofar as the scope of the Product Liability Act is applicable.

8. LIABILITY
For claims arising from damages caused by us, our legal representatives, or vicarious agents, we are always fully liable.
• in case of injury to life, body, or health
• in case of intentional or grossly negligent breach of duty
• in case of warranty promises, as agreed, or
• insofar as the scope of the Product Liability Act is applicable.
In the event of a breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on which the contracting party may regularly rely (cardinal obligations), due to slight negligence by us, our legal representatives, or vicarious agents, liability is limited in amount to the foreseeable damage at the time of contract conclusion, which typically must be expected to occur.
Furthermore, claims for damages are excluded.
9. DISPUTE RESOLUTION
The European Commission provides a platform for online dispute resolution (ODR), which you can find here [https://ec.europa.eu/consumers/odr/]. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
